JACK IN THE BOX FREE WI-FI SERVICES ACCEPTABLE USE POLICY

Jack in the Box is pleased to offer wireless Internet access to our guests.

In order to use the Jack in the Box Guest Wi-Fi Network (the "Network"), you must read and agree to the terms of this Network Access Policy by clicking "ACCEPT & CONNECT." By clicking on "ACCEPT & CONNECT" you acknowledge that this Policy governs your use of the Network, and that you agree to all of its terms and conditions. We may update this Policy from time to time, so please read it each time you connect to the Network.

Jack in the Box may monitor the use of the Network and any information sent or received over the Network, including, without limitation, URLs of websites visited and the unique identifier of the device you use to connect to the Network. You must have no expectation of privacy with respect to use of the Network, except where local law provides otherwise. The Network and related equipment are the sole property of Jack in the Box. You may not remove, disable or bypass Jack in the Box security controls or user authentication requirements, interfere with any user's access, or attempt to gain unauthorized access to any part of the network. You are required to use the system ethically and in compliance with all applicable laws.

You must not introduce any malicious programs to the Network or related server or cause security breaches or disruptions of network communication. As with most public wireless "hot spots," Jack in the Box Guest Wi-Fi Network is not secure. Any information being sent or received could potentially be intercepted by another wireless user. Cautious and informed wireless users should not transmit their credit card information, passwords and any other sensitive personal information while using any wireless "hot spot."

You are responsible for configuring and maintaining the devices that you connect to the Network. Jack in the Box reserves the right to disconnect you or the entire Network at any time in our sole discretion. Jack in the Box may choose to filter or block some uses of the Network in our sole discretion, from time to time, and at any time, but we are under no obligation to do so.

THE Jack in the Box GUEST WI-FI NETWORK IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. Jack in the Box RESERVES THE RIGHT TO REVOKE ACCESS AT ANY TIME AND WITHOUT NOTICE. Jack in the Box DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Jack in the Box MAKES NO EXPRESS WARRANTIES, AND YOU WAIVE ANY AND ALL IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. YOU EXPRESSLY ACKNOWLEDGE THAT THERE ARE, AND ASSUME ALL RESPONSIBILITY RELATED TO, THE SECURITY, PRIVACY AND CONFIDENTIALITY RISKS INHERENT IN WIRELESS COMMUNICATIONS AND TECHNOLOGY, AND Jack in the Box DOES NOT MAKE ANY ASSURANCES OR WARRANTIES RELATING TO SUCH RISKS. NO ADVICE OR INFORMATION GIVEN BY Jack in the Box OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY.

You agree to indemnify, defend and hold harmless Jack in the Box, its affiliates (including its parent), and their officers, directors, employees, contractors, agents, licensors, service providers, subcontractors, and suppliers from and against any and all claims, losses, liabilities, expenses, damages and costs, including reasonable attorneys' fees and court costs, arising or resulting from use of the Network and also including, without limitation, any liability arising from any compromise of any personal information (e.g. credit card), or for any damage caused to your hardware or software due to electric surges, security issues or consequences caused by viruses or hacking. If you cause a technical disruption of the Network or to related equipment or data, or violate this Policy, you agree to be responsible for any and all losses, liabilities, expenses, damages and costs, including reasonable attorneys' fees and court costs, arising or resulting from such actions. Jack in the Box reserves the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you and, in such case, you agree to cooperate with us in the defense of such matter.

You must not use the Network to procure or transmit material that is offensive, obscene or otherwise in violation of harassment or discrimination laws in the user's local jurisdiction, or use the Network to engage in any form of harassment via email or other electronic communication whether through language, content, frequency or size of messages using the Network.

Any claim arising out of use of the Network or this Policy is governed by the laws of California - without regard to conflicts of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in California, for the resolution of any and all disputes arising out of or relating to the Network or this Policy. You agree not to bring suit in any other jurisdiction.
